The respective positions for which you can apply as an applicant are formally advertised by a company within the CHECK24 Group. You can find out which company this is from the respective job advertisement.
In this context, CHECK24 Personal acts exclusively as a central contact and therefore advisor both for you as an applicant and for all affiliated companies within the CHECK24 Group in the area of recruiting. In this way, CHECK24 Personal can offer and grant you, as an applicant, fast and comprehensive support for all positions to be filled within the CHECK24 Group.
CHECK24 Personal has been authorised by all affiliated companies from the CHECK24 Group to carry out or issue the entire application process – for example reviewing the application documents, coordinating the job interviews, correspondence, etc., but also rejections in the name and on behalf of the companies concerned.
Even if you as an applicant apply formally for a position at the company of the CHECK24 Group named in the job advertisement, your application will be processed and managed solely by CHECK24 Personal. If it turns out in the course of your current application that you may be better suited for another position within the CHECK24 Group, either from the point of view of your advisor and/or from the point of view of the company to which you originally applied, CHECK24 Personal within a certain framework, primarily taking into account your place of residence or the registered office of the company to which you have applied, may proactively expand the search for you and also present your profile to other companies from the CHECK24 Group.
Important: At no time does CHECK24 Personal or any other company from the CHECK24 Group guarantee and/or owe you, the applicant, the successful placement of an employment relationship, either from this mediation contract or from any other action.
1 Definitions
- “CHECK24 Job Portal”
Website through which an applicant can apply for an advertised position within the CHECK24 Group.
- “Data controller”
The data controller within the meaning of Article 4 No. 7 GDPR is CHECK24 Personal.
- “we”
If “we” is mentioned in this mediation contract, this always means CHECK24 Personal.
- “Applicant”
The term “applicant” is understood to mean any person, regardless of gender, who uses the Job Portal and/or applies for a position.
- “Advisor”
The term “advisor” is understood to mean the person, regardless of gender, who is assigned to an applicant as a personal contact by CHECK24 Personal when submitting his application.
- “CHECK24 Group” or “affiliated companies of the CHECK24 Group”
see Section 8
- “Consumer”
Consumers here within the meaning of Section 13 German Civil Code (BGB)
2 Conclusion of the contract
By clicking on the checkbox “I hereby authorise CHECK24 Services Personal GmbH" to provide free support as part of my application to CHECK24 and accept the mediation contract” and then click on the “Submit application” button, the applicant concludes a free support and processing contract (hereinafter referred to as “mediation contract “) with CHECK24 Personal. With the conclusion of the mediation contract, the applicant commissions CHECK24 Personal in a non-exclusive way with support and processing services (hereinafter referred to as “services”) as part of his application submitted to a company within the CHECK24 Group; in particular with the proactive check by CHECK24 Services Personal whether the applicant is also suitable for other possible positions within the CHECK24 Group.
At no time does CHECK24 Personal guarantee and/or owe the applicant an employment or employment relationship through these contractually offered services. This decision is the sole responsibility of a company from the CHECK24 Group and is to be established by a separate written employment contract between this company and the applicant. CHECK24 Personal also never guarantees and/or owes the applicant the successful placement of a corresponding job or employment relationship within the CHECK24 Group. Furthermore, neither the offering of this contract nor the acceptance of this contract by CHECK24 Personal constitutes a promise of a binding employment relationship either with CHECK24 Personal or with any other company from the CHECK24 Group. Should an employment relationship arise following the services rendered by CHECK24 Personal, this shall come about exclusively between the applicant and the respective contractual partner (hereinafter referred to as “parties”) within the framework of a separate written employment contract to be concluded between the parties concerned.
The customer has no right to the conclusion of this mediation contract.
The contract language is German.
3 Services of CHECK24 Personal
3.1 Review and forwarding of submitted application documents
CHECK24 Personal will check the documents submitted by an applicant for completeness and may request missing and/or incomplete documents. If the application documents are complete, CHECK24 Personal will forward them to the appropriate department within the company to which you have applied.
This service is essential and cannot be objected to by the applicant.
3.2 Secretarial services
CHECK24 Personal takes care of all “secretarial services” for both the applicant and the companies of the CHECK24 Group as part of this application process. In addition to the normal handling of correspondence, these services also include appointment and room coordination in the context of a possible job interview, but also the formal transmission of rejections in the name and on behalf of the relevant companies.
This service is essential and cannot be objected to by the applicant.
3.3 “Transfer” to a possible other position
If it turns out during the application process that the applicant profile could be a better fit and therefore more suitable for a similar position at another company within the CHECK24 Group that corresponds to the applicant profile, CHECK24 Personal will work proactively for the applicant - the applicant does not have to do anything regarding this.
In this case, CHECK24 Personal will share the profile of the applicant with other companies from the CHECK24 Group that are either active in the region in which the applicant currently lives according to his application, or that are located in the region to which the applicant originally applied for consideration. If the company or companies concerned are interested, we shall inform you about this and send you a corresponding proposal. It is up to you whether you want to accept this proposal and then continue with the application for the new position.
This service is essential and you as an applicant cannot object to it.
4 Submission of the application documents
4.1 Upload via Job Portal
With our CHECK24 Job Portal, we offer applicants the opportunity to apply for a position within the CHECK24 Group in a simple, convenient and targeted manner. Consequently, the CHECK24 Job Portal also offers an upload function for documents. With the help of this function, the applicant can provide us with various documents, such as a cover letter, curriculum vitae, certificates, letters of recommendation, etc., securely via an encrypted connection as part of his application.
4.2 Applicant data from Xing
As part of the application process, we offer you the option to log in to our CHECK24 Job Portal with your XING profile, which is provided and operated by XING AG, Dammtorstrasse 30, 20354 Hamburg (hereinafter referred to as “XING”) so that certain data will already be pre-populated in our application form using the information from your XING profile. The use of this XING service is governed exclusively by the privacy policy of XING, which you can access here: https://www.xing.com/privacy
It is important to note that only you are able to initiate permitted access to your XING profile and to transfer your data from the same profile from XING to CHECK24 Personal following your active consent.
CHECK24 Personal may receive more data from you via the XING interface than we can use and display in our application forms. Furthermore, CHECK24 Personal has no influence over the scope of the data transmitted via the XING interface. This is exclusively the responsibility of XING and, according to XING, you as a customer can actively influence certain settings in your XING account.
4.3 Applicant data from LinkedIn
As part of the application process, we offer you the option to log in to our CHECK24 Job Portal with your LinkedIn profile, which is provided and operated by LinkedIn Ireland Unlimited Company, Wilton Place, Dublin 2, Ireland (hereinafter referred to as “LinkedIn”) so that certain data will already be pre-populated in our application form using the information from your LinkedIn profile. For the use of this LinkedIn service, only the privacy policy of LinkedIn applies, which you can access here: https://www.linkedin.com/legal/privacy-policy
It is important to note that only you are able to initiate permitted access to your LinkedIn profile and to transfer your data from the same profile from LinkedIn to CHECK24 Personal following your active consent.
CHECK24 Personal may receive more data from you via the LinkedIn interface than we can use and display in our application forms. Furthermore, CHECK24 Personal has no influence over the scope of the data transmitted via the LinkedIn interface. This is solely the responsibility of LinkedIn.
4.4 Submission by email
We expressly recommend that you do not send us applications by email, but only use the CHECK24 Job Portal for this purpose. This is the only way to ensure the secure and targeted transmission of your application to CHECK24 Personal.
If you nevertheless submit the application to CHECK24 Personal by email, this mediation contract also applies to the application submitted in this way. In this case, your personal advisor will send you a corresponding explanation.
4.5 Change of applicant data
If there have been any changes to your information during the application process and/or you have found that you made a mistake in your application documents, we would urge you to contact your personal advisor immediately and let us know about the change. This is essential for the correct processing and consideration of your application.
5 Obligations of the applicant
Without the voluntary and active provision of the complete and truthful application documents by the applicant and without the active consent of the applicant to this mediation contract, the application cannot be processed by CHECK24 Personal or by the affiliated companies of the CHECK24 Group that have advertised the position and be taken into account.
6 Liability
CHECK24 Personal has unlimited liability for any damage in the event of intent and gross negligence, including that of its vicarious agents. In the event of a slightly negligent violation of a primary obligation or a secondary obligation, the violation of which jeopardizes the achievement of the purpose of the contract or the fulfilment of which is essential for the proper execution of the contract and on whose compliance the applicant could rely (hereinafter referred to as “essential secondary obligation”), the liability of CHECK24 Personal is limited to the foreseeable, contract-typical damage at the time the contract was concluded. CHECK24 Personal is not liable in the event of a slightly negligent breach of an obligation that is not an essential secondary obligation. The above exclusions and limitations of liability do not apply in the event of fraudulent intent, the assumption of a guarantee or liability for damage resulting from injury to life, limb or health. This does not involve a change in the burden of proof to your disadvantage.
7 Costs
The applicant shall not incur any costs as a result of this mediation contract and the services used of the CHECK24 Job Portal and CHECK24 Personal and the affiliated companies of the CHECK24 Group that have advertised the vacancies, with the exception of any basic costs of the Internet provider for the use of the Internet, the telephone provider in the case of telephone queries and possible postage costs in the case of postal submissions.
8 Affiliated companies of the CHECK24 Group
The following companies are affiliated companies of the CHECK24 Group, for which CHECK24 Personal, as the central internal service provider, is responsible for the entire application process:
9 Duration of contract, termination
9.1 Duration of the contract
This mediation contract is limited in time and begins with the active sending and/or submission of the application by the applicant.
The obligations to provide the services on the part of CHECK24 Personal and the obligations of the applicant exist as long as neither the applicant nor CHECK24 Personal have effectively terminated the contract.
The contract ends automatically without notice, without the need for a separate termination,
- if the applicant actively withdraws his application,
- gives a rejection of an offer,
- terminates this mediation contract and/or
- takes an action and/or expresses and/or makes a statement that
If CHECK24 Services Personal rejects the application of the applicant and/or sends the application documents back to him, this mediation contract will automatically end without CHECK24 Personal requiring a separate termination.
9.2 Termination
The mediation contract can be terminated by the applicant at any time without giving reasons with immediate effect. The termination must be in text form to be legally effective. This termination by the applicant formally represents a withdrawal of the previously submitted application.
This mediation contract is terminated by CHECK24 Personal with a formal rejection and/or the return of the application documents within a period of 7 days.
The right to extraordinary termination on the part of both the applicant and CHECK24 Services Personal remains unaffected.
10 Privacy
The data recorded or transmitted by the applicant will be processed exclusively for the purposes of the contractually defined and requested services. For more information, please refer to the privacy policy.
11 Note on dispute resolution pursuant to the Consumer Dispute Settlement Act
The European Commission provides a platform for the extrajudicial online settlement of disputes (ODR platform) for all disputes arising in connection with this mediation contract on the part of CHECK24 Personal GmbH regarding a consumer, available at https://ec.europa.eu/odr/.
CHECK24 Personal points out that we are neither willing nor obliged to participate in dispute settlement procedures before a consumer arbitration board.
12 Text form, partial invalidity, applicable law
Changes, additions and other ancillary agreements made before or during the conclusion of the contract must be in text form (letter, fax, email) to be legally effective. Subsequent changes or additions should also require text form.
Should provisions of these Terms of Use be or become invalid or unenforceable, or should a gap be found in these Terms of Use, this shall not affect the validity of the remaining provisions.
The contractual relationships between the parties (applicant and CHECK24 Personal) are based on the law of the Federal Republic of Germany. If the applicant is a consumer and has his habitual residence in another EU Member State, the mandatory consumer protection regulations of the country of his habitual residence remain applicable in favour of the customer.
13 Withdrawal policy
13.1 Right of withdrawal
You have the right to revoke this contract within fourteen days without specifying any reasons. This right of revocation is valid for 14 days from the day the contract was concluded.
In order to exercise your right of withdrawal, you as an applicant must contact CHECK24 Services Personal GmbH, Fax: 089 2000 47-1011, e-mail: career@check24.de by means of a clear statement (e.g. a letter sent by post, fax or e-mail) of your decision to withdraw from this contract.
To comply with the withdrawal period, it is sufficient that you send the notification of the exercise of the right of withdrawal before the end of the withdrawal period.
13.2 Consequences of withdrawal
If you, as an applicant, decide to revoke this mediation contract in its entirety, we can no longer process your application. In this case, as an applicant, you actively express a withdrawal of your application with immediate effect.
