1 General information
CHECK24 Services Personal GmbH in 80636 Munich (hereinafter referred to as "CHECK24 Services Personal") acts, among other things, as a central internal service provider for all affiliated companies within the CHECK24 Group in the field of recruiting. In this context, it also operates the CHECK24 job portal and thus also acts as a central contact for both external and internal applicants as well as for all affiliated companies within the CHECK24 Group. In addition, CHECK24 Services Personal provides further internal services to the affiliated companies within the CHECK24 Group.

3 Which of your data do we process?
1 General
We would like to make it clear that we do not at any time purchase personal data relating to you from third parties. Any personal data we have about you has been voluntarily submitted to us as part of your application and/or is collected and processed as part of a potential employment relationship.
2 Category of data
(a) Visiting the website
When you access our websites, we collect the following data, which is generated by the system when you use the Internet and is technically necessary for us to be able to display our websites to you. This is the only way we can guarantee the stability and security and therefore the smooth operation of our website.

This data is temporarily stored in the log files of our system for a maximum of seven days. Afterwards, these server logs are permanently deleted. At the same time, the data obtained in this way is used, among other things, as part of statistical evaluations regarding the optimisation of our website. Additional storage of this data is possible in certain exceptional cases, for example if we would detect corresponding cases of fraud, hacking attempts, etc. within this period. This is the only way we can guarantee the security and stability of the system. The log files are not stored at any time together with other personal data relating to you, in particular if you are the holder of a CHECK24 customer account with CHECK24 GmbH.
The legal basis for these processing operations is Art. 6 (1) lit. f GDPR.
Since the collection of data to display the websites and the storage of the data in log files is absolutely necessary for the operation of our websites and the maintenance of IT security, you do not have the option to object in this respect.
(b) Submission of application documents
- If you submit an application to us, we will store and process all information and documents that you voluntarily provide to us as part of this process and thus for the performance of the service contract. We may store the following categories of data in this context, with a maximum retention period of 6 months:
Name, contact details (postal and e-mail address, telephone number etc.), date of birth
Possibly photo of you
Information about your educational and professional background
Possibly educational certificates (school, training, FH and/or university degrees, etc.) and work references

The legal basis for these processing operations is Art. 6 Abs. 1 lit. b GDPR.
4 On what legal basis do we process your data?

5 What data is shared and why?
1 General
We would like to make it clear that we neither sell your data at any time, nor make your data available to any third parties.
If we should have personal data from you, then you have voluntarily provided us your personal data in the context of an application (see section 3).
In order to fulfil the service contract concluded between you and CHECK24 Services Personal in the context of your application procedure, your personal data will be processed within the scope of this contract, and therefore for the fulfilment of this contract.
Notwithstanding this contract-related transfer of data, in individual cases data may also be forwarded to third parties if we can prove a corresponding legitimate interest (Art. 6 para. 1 lit. f GDPR).
Furthermore, like many other companies, we use various external service providers in order to be able to provide you with our services. However, before we enter into such a cooperation with a service provider and this service provider becomes active on our behalf, we ensure that corresponding legally appropriate contractual provisions are made with this service provider. Only then can and will these external service providers act on our behalf.
Furthermore, where this transfer is indispensable, we ensure that
1. only those companies receive your data that are necessary for the processing of this transaction (hereinafter referred to as "recipients"), and
2 Recipient
With reference to Art. 6 (1) GDPR, we may only process and/or pass on information about an applicant and/or information in connection with an existing employment relationship if
(a) you have consented as the data subject,
(b) this is required for processing with the contractual obligations such as the service contract,
(c) legal regulations require or make this necessary,
(d) we are authorised by public bodies and institutions to provide information; or
(e) processing is necessary for the purposes of a legitimate interest of ours which is not overridden by your interests or fundamental rights and freedoms concerning the protection of your personal data
Under these conditions, the following recipients may receive personal data:
1. Within our company
Those company bodies that require your data to fulfil our contractual and legal obligations will receive access to it. Service providers and vicarious agents employed by us may also receive data for these purposes within the framework of order processing relationships (pursuant to Art. 28 GDPR). These are companies in the categories IT services, personnel support, payroll accounting, accounting, telecommunications, printing services, e-mail services.
2. Within the CHECK24 network - application procedure
As part of your application, we will forward your application in the first step to the company within the CHECK24 network that has advertised the position for which you have applied directly. If, during the application process, your HR advisor at CHECK24 Services Personal identifies a more suitable and/or an alternative vacancy within the CHECK24 network, your HR advisor will forward your application to other companies within the CHECK24 network within the scope of the service agreement (see section 3.3 of the service agreement). Upon request, your HR consultant will of course inform you of the companies within the CHECK24 network that have also received your application documents.
3. Outside our company and outside the CHECK24 network
We may only pass on information about our applicants if the group of persons concerned has consented to this, if this is necessary for the fulfilment of contractual obligations, if legal provisions require this, if it does not conflict with your interests or if we are authorised to provide information by public bodies and institutions. Under these conditions, the following recipients may receive personal data:
Public bodies and institutions (e.g. tax authorities, law enforcement agencies, public prosecutors' offices, courts, social insurance institutions, offices and authorities, etc.) if there is a legal or official obligation to do so.
4. Transfers abroad
Your personal data will not be transferred abroad. Should, contrary to expectations, a transfer take place in the future, we will of course fully comply with the provisions set out in Art. 44ff GDPR and in particular the necessary guarantees set out in Art. 46 GDPR, among others.
6 What data do we receive?
We would like to make it clear that, just as we neither sell or give away your data at any time, nor do we make your data available to any third party, we will not purchase your personal data from third parties, neither now nor in the future.
If you use the transmission of your profile data on Xing and/or LinkedIn as part of your application process, we will temporarily receive this data, which you have actively released there, for the pre-filling of the application form if you actively and explicit agree to the transmission of this data to us from the above mentioned companies. For more details, see section 9.
We also cannot exclude the possibility that various headhunters who were commissioned by you independently may provide us your profile in anonymised form or have done so in the past. At no time is it possible for us to specifically assign the data received from your headhunter to your person. The anonymisation of this data is the sole responsibility of the headhunter commissioned by you. Therefore, we would like to ask you to contact the headhunter you have engaged directly and to question the transfer of your data. We cannot help you in this context, especially in the context of a data disclosure, as we cannot create an identifiable person from this data.
7 How long do we store your data?
1 General
In general, we only store your data for as long as is absolutely necessary. To this end, we have set various deletion periods, which firstly depend on the actions you have carried out and secondly take into account the resulting retention periods and therefore obligations for us. As a result, we may have to retain your data for significantly longer than we would like and even if you actively request deletion of your data.
2 Standard
In the context of your application process, we will store the data for up to 6 months after sending you the rejection or 6 months after withdrawing your application. This period is based on Art. 17 (3) e GDPR. If you have consented to be included in our talent pool/talent community (see 4.1), your personal data will be stored and processed in accordance with the applicable data protection regulations for future positions at CHECK24 depending on the individually agreed contact, otherwise for 24 months from the date of your consent. By being included in the talent pool/talent community, we make regular contact to talk about entry opportunities and newsletters that provide information about news and events at CHECK24. Each newsletter includes the option to unsubscribe from the mailing list. In the event of a rejection, the storage period is unaffected due to further possible job offers in the future. This period results from Art. 5 (1 e) GDPR. You are of course free to object to your consent to the storage or processing of your application data at any time (see 8.5).
3 Statutory limitation periods
3 years beginning with the end of the calendar year in which the financial year in which the entitlement existed ends.
4 Legal
Depending on the actions you have performed with us, we may be subject to various statutory retention obligations. The periods specified there for storage or documentation are generally two years.
8 What data protection and objection rights do you have?
In the following, we would like to briefly explain your data protection rights.

2 Right of rectification (Art. 16 GDPR)
If your data stored with us is incorrect and/or incomplete, you have the right to have it corrected and/or completed.
3 Right to erasure (Art. 17 GDPR)
You are free to request the deletion of your data from us. We already delete your data automatically after the expiry of certain periods on the basis of Art. 17 Para. 1 and Para. 3 GDPR or § 35 Para. 2 and Para. 3 BDSG - irrespective of a possible active deletion request on your part.

We would like to point out that, depending on the actions you may have taken with us in the past, we may have different rights and obligations with regard to the retention of your data over time.
Application procedure
If you have gone through an application process in the past, we are legally obliged to keep these documents for up to 6 months after rejection or withdrawal of the application. After these periods have expired, the corresponding data will of course be finally deleted in accordance with Art. 17 Para. 1 lit. a GDPR.
Note
If you would like to make use of your right to deletion and do not expressly mention that you would like your data to be deleted from all companies within the CHECK24 network, we as CHECK24 Services Personal will delete your data exclusively from us. If, on the other hand, you would like all your data to be deleted from all companies within the CHECK24 network, you are welcome to inform us of this. We will then forward your request accordingly.
4 Right to object (Art. 21 GDPR)
You have the right to object at any time, on grounds relating to your particular situation, to the processing of personal data concerning you, provided that the processing is carried out on the basis of legitimate interest (Article 6(1)(f) GDPR); this also applies to profiling based on these provisions.
You can find the recipient of the objection in point 11.
Further information
If you exercise this objection, we will no longer process the personal data in question with effect for the future. If, on the other hand, we can demonstrate compelling legitimate grounds for the processing which override your interests, rights and freedoms, or if the processing serves the purpose of asserting, exercising or defending legal claims on our part, we must in this case refuse your request.
5 Right to revoke consent (Article 7 (3) of the GDPR)
You may revoke your consent to the processing of personal data at any time. This also applies to the revocation of declarations of consent given to us prior to the application of the GDPR, i.e. prior to 25 May 2018.
Further information
Please note that a revocation always refers to a previously given consent and is effective exclusively with regard to the future and never to the past. This means that the revocation has no influence on the lawfulness of the processing that took place before this revocation was issued.

1 Notes on cookies and similar technologies
As part of the continuous improvement of the offer for our users, additional tracking technologies may be used by third-party providers and us, which use anonymous and temporary "session cookies" as well as "persistent cookies". Unfortunately, we cannot tell you to what extent and on what basis this will happen.
